I'M A REPRESENTATIVE OF THE OHIO CANNABIS COMPANY, AND I'M HERE TO REQUEST THE CONSIDERATION OF TWO VARIANCES IN THE SPECIAL USE PERMIT TO ALLOW OUR COMMUNITY TO BETTER SERVE YOUR COMMUNITY. OUR FIRST REQUEST IS THE REDUCTION OF THE RESIDENTIAL PROPERTY DISTANCE FROM 500FT TO LIKE 390 SOME FEET, AND TO PERMITTING A DRIVE THROUGH FOR A MEDICAL PATIENTS. I WANT TO EMPHASIZE WE HAVE A PROVEN TRACK RECORD OF OPERATING RESPONSIBLY AND WITH INTEGRITY. OHIO DISPENSARIES ARE CONFIGURED AND RAN SLIGHTLY DIFFERENT THAN OTHER STATES. OUR PRODUCTS ARE HELD IN A FULFILLMENT ROOM, AND RATHER THAN A RETAIL SHOPPING AREA, OUR ORDERS ARE PLACED AND FULFILLED IN THE FULFILLMENT ROOM, OUT OF THE SIGHT OF PATIENTS AND OUT OF THE SIGHT OF CUSTOMERS. THIS INDUSTRY IS HIGHLY REGULATED AND WE ALWAYS ADHERE TO STATE AND LOCAL REQUIREMENTS TO MAINTAIN A SAFE AND SECURE, ORDERLY BUSINESS. QUITE SIMPLY, IF WE

ADDITIONALLY, TAX REVENUE FROM THE ADULT USE CANNABIS SALES WILL SERVE TO BENEFIT THE COMMUNITY. THAT IS, THAT 3.36% OF THE ADULT USE SALES. BEYOND THAT, HAVING A DISPENSARY WILL HELP SERVE RESIDENTS WHO HAVE TO TRAVEL OUTSIDE THEIR COMMUNITY FOR MEDICATION, AND THIS IS AN IMPORTANT CONVENIENCE TO EASE THEIR BURDEN. I KNOW SOME MAY HAVE QUESTIONS ABOUT THE DISTANCE BETWEEN OUR FACILITY AND THE APARTMENT DOWN THE ROAD. WHILE THIS THIS LOCATION IS BETTER SUITED THAN OTHER LOCATIONS THAT DO HAVE THE 500 FOOT DISTANCE. OURS IS AT THE CORNER LOT WITH TRAFFIC LIGHTS AND HAS TWO ENTRANCE AND EXIT POINTS. WHILE MEASURING THE BUILDING DISTANCE BETWEEN OUR BUILDING AND THE APARTMENTS, OUR DISPENSARY BUILDING TO BUILDING IS 400 AND OVER 500FT TO THE CLOSEST APARTMENTS, AND IF YOU GO TO DOOR, IT'S WELL OVER 570 CLOSER TO 600. HOWEVER, HOWEVER, THE NUMBER OF VISITORS TO OUR DISPENSARY IS GOING TO BE MODEST IN COMPARISON. THEY BELIEVE THERE'S ANOTHER BETTER USE OR BETTER SITE OUT THERE THAT WOULD FIT THIS TYPE OF DISPENSARY. I'M NOT SAYING I AGREE WITH IT PERSONALLY OR STAFF, BUT THAT IS THE RECOMMENDATION FROM THE PLANNING COMMISSION WHO VOTED 0 TO 5. I CAN ANSWER ANY QUESTIONS YOU MAY HAVE. THANK YOU, MR. RAUCH. I WANTED TO ALSO CLARIFY SOME CONFUSION IN OUR COMMUNITY REGARDING THIS SPECIAL USE PERMIT AND HOW WE'VE GOT HERE. OBVIOUSLY, BACK IN NOVEMBER OF 2023, STATE ISSUE TWO DID PASS TO ALLOW RECREATIONAL MARIJUANA DISPENSARIES IN THE STATE OF OHIO ON FEBRUARY 2ND OF LAST YEAR, COUNCIL VOTED TO AMEND THE CHAPTER 732. AND PLEASE CORRECT ME IF I'M INCORRECT TO ALLOW MEDICAL AND RECREATIONAL BECAUSE THAT WE DIDN'T HAVE ANY RECREATIONAL OR MEDICAL MARIJUANA PRIOR TO THAT. SO WE VOTED TO AMEND THAT CHAPTER TO ALLOW MEDICAL AND RECREATIONAL. AND THEN ON AUGUST 6TH OF 2024, THE DIVISION OF KANSAS CANNABIS CONTROL PUT IN STATE REGULATIONS ON HOW TO MANAGE DISPENSARIES IN OHIO AFTER ISSUE TWO PASSED, BECAUSE WE DIDN'T HAVE ANYTHING IN PLACE AS A CITY ON AUGUST 19TH OF 2024, COUNCIL AMENDED SECTION 1135. 09B 12 A TO INCLUDE A NEW SECTION FOR MARIJUANA RULES AND REGULATION.

AND THAT'S KIND OF WHERE WE ARE TODAY. NOW WE HAVE A SPECIAL USE IN FRONT OF US. WITH RESTRICTIONS. AND SO THIS IS A DISCUSSION THAT WE'RE GOING TO HAVE WHETHER OR NOT WE APPROVE OR DISAPPROVE THIS. SO WITH THAT SAID I'M GOING TO OPEN. OH, AND THEN FOR PUBLIC RECORD, WE DID RECEIVE NUMEROUS EMAILS FROM RESIDENTS AND NONRESIDENTS. TO THE CLERK OF COUNCIL. AND WE JUST WANT TO LET EVERYBODY KNOW THAT THOSE WILL BE PART OF THE PUBLIC RECORD. ON THIS SPECIAL USE REQUEST. AND WITH THAT, I'M GOING TO OPEN IT FOR QUESTIONS FROM COUNCIL. MR. HOLT. JUST A COUPLE COMMENTS. SO ONE OF MY JOBS ON COUNCIL IS TO DO WHAT THE PEOPLE WANT. IT'S NOT MY ONLY JOB AND IT HAS RESTRICTIONS. AND I GOT A PRETTY CLEAR INDICATION BACK IN 2023 THAT THE PEOPLE IN THE STATE OF OHIO WANTED MARIJUANA. GROVE CITY RESIDENTS VOTED 60% IN FAVOR OF THAT. SO IT'S CLEAR THAT. AND SO WHILE THERE ARE PEOPLE OUT THERE THAT DON'T AGREE, IT'S IMPORTANT TO UNDERSTAND THAT THE LEGISLATIVE PROCESS AND THE VOTING PROCESS PRODUCE 60% POSITIVE FOR MARIJUANA IN GROVE CITY. IN ADDITION, WHEN WE STARTED PUTTING WE PUT IN SPECIAL RULES ON TOP OF THE STATE RULES. SO WE MADE IT EVEN MORE STRICT THAN WHAT THE STATE SAID. THE STATE PUBLISHED A SET OF RULES. WE IN GROVE CITY SAID, WELL, WE'D LIKE A FEW MORE DIFFERENT RULES. AND AS AN EXAMPLE, WE CHANGED THE DISTANCE TO RESIDENTIAL.

ACTUALLY, WE INVENTED THE RESIDENTIAL DISTANCE AND PUT THAT IN THERE. AND 500FT WAS THE NUMBER WE LANDED ON. WE ALSO MADE THE DRIVE THROUGH RULE IN THERE, AND WE ALSO MADE THE RULE THAT THERE WOULD ONLY BE TWO IN GROVE CITY. SO WE CAN'T HAVE 20 OF THESE THINGS. WE'RE ONLY GOING TO HAVE TWO, AND THEY'RE GOING TO BE GOVERNED BY THE SPECIAL USE PERMIT. NOW, THE PROCESS OF A SPECIAL USE PERMIT, WHICH WE'RE IN RIGHT NOW, IS UP TO COUNCIL TO VOTE. NOW, YOU HEARD EARLIER THAT THE PLANNING COMMISSION DEVELOPMENT DEPARTMENT VOTED NO ON THAT. AND THAT'S SPECIFICALLY BECAUSE THEIR JOB IS TO EVALUATE THE REQUEST BASED ON THE RULES THAT ARE IN PLACE. AND MR. WHITFIELD'S REQUEST ALSO INCLUDED A DRIVE THROUGH. AND IT WASN'T 500FT FROM RESIDENTIAL. SO PLANNING COMMISSION AND DEVELOPMENT HAD NO OTHER OPTION TO VOTE NO ON THAT BECAUSE IT DID NOT MEET THE RULES THEY DON'T MAKE SOCIAL DECISIONS OR ANYTHING LIKE THAT. THEY'RE JUST FOLLOWING THE RULES THAT HAVE BEEN PUBLISHED AND AGREED UPON.

AND I KNOW THERE'S A PERMITTING APPLICATION WHERE YOU HAVE TO PUT YOUR SITE AND HAVE ALL YOUR PAPERWORK IN, IN ORDER IN ORDER FOR US TO APPROVE THIS SITE. SO A LITTLE KNOWN QUIRK ABOUT SPECIAL USE PERMITS. THEY FOLLOW THE PROPERTY, NOT THE BUSINESS PERSON. SO MY DIRECT QUESTION IS TO YOU IS DO YOU HAVE ALL THE PROPER PERMITTING DOCUMENTS FILED WITH THE STATE FOR THIS LOCATION TODAY THAT WE'RE TALKING ABOUT? SO WE ARE KIND OF IN THE MIDDLE OF THAT SITUATION RIGHT NOW. THEY'VE GIVEN US THE OKAY AT THIS LOCATION, BUT WE HAVE NOT RECEIVED OUR PROVISIONAL LICENSE YET, AND I WAS GOING TO WAIT ON THAT UNTIL WE HAD BEEN THROUGH THIS PROCESS SO THAT WE'RE NOT GOING DOWN THAT PATH UNTIL WE'RE HERE. YES, THERE'S GOING TO BE I I'M NOT 100% SURE ON THE LEGAL AVENUES ON THIS, BUT MY UNDERSTANDING IS, IS WE FINISH THIS, WE GET THE ZONING, AND FROM THERE THEN WE'LL DO THE PERMIT AND THE BUILD BASED UPON THE ARCHITECTURAL PLANS. HOWEVER, BASED ON WHAT THE APPLICANT IS SAYING, I WOULD SUGGEST THAT COUNCIL, CONSIDERING SOME TYPE OF SUNSET PROVISION IN HERE WHEREBY THE APPLICANT WOULD BE REQUIRED TO OBTAIN THE PROVISIONAL LICENSING WITHIN 90 DAYS, 60 DAYS, SOMETHING ALONG THOSE LINES, JUST TO ENSURE. AS MANY OF YOU ALREADY KNOW, MOST PEOPLE WHO DEVELOP AN ADDICTION PROBLEM STARTED USING SUBSTANCES IN THEIR TEENS. WE INITIALLY FORMATTED OUR PROGRAM AFTER THE OHIO DEPARTMENT OF EDUCATION START TALKING OHIO PROGRAM. YOU MAY HAVE SEEN OR HEARD THE COMMERCIALS WITH MESSAGING OF DON'T LIVE IN DENIAL, OHIO.

AFTER A FEW PRESENTATIONS, WE SOON REALIZED THAT IT WASN'T JUST OUR YOUTH THAT NEEDED MORE PREVENTION AND SOLUTION INFORMATION AND RESOURCES. NOW WE NEED TO ENTER INTO A MASTER SUPPLY AGREEMENT SO THAT THEY CAN GO ABOUT PURCHASING THE ENERGY FOR THE NEXT TWO YEARS FROM THE CITY OF GROVE CITY. IN THIS GROUP IS ALMOST EVERY SCHOOL DISTRICT IN FRANKLIN COUNTY, INCLUDING COLUMBUS CITY SCHOOLS, SOUTHWESTERN CITY SCHOOLS. THE CITY OF HILLIARD IS IN IT THE CITY OF GRANDVIEW, BUT NEARLY EVERY SCHOOL DISTRICT IS IN THIS GROUP. THE REASON WE NEED AN EMERGENCY IS ELECTRICITY. SOME SOMETIMES WE THEY PURCHASE IT ALL AT ONE TIME AND IT'S A FIXED PRICE. THIS INSTANCE IS THE RFP THAT WAS AWARDED BY THIS GROUP. THE BOARD DECIDED TO DO A MONITORING OF THE MARKET. DURING THIS TIME WE'VE USED 200 TONS OF SALT THROUGH TODAY, WITH THE WEATHER CONDITIONS FOR TOMORROW, WE'LL PROBABLY USE ANOTHER 200,000 TO 200 TONS OF SALT TOMORROW THAT WILL LEAVE US ON HAND. THOUSAND TONS. WE DO ALSO HAVE PRIVATE CONTRACTORS WITHIN THE CITY, MAINLY DOING CUL DE SAC WORK.
